Terms and Conditions of Participation — giveaway for the start of the Ottobock brand campaign

1. Organizer 

The organizer of the giveaway is Ottobock SE & Co. KGaA (hereinafter "Organizer"), Max-Näder-Straße 15, 37115 Duderstadt, Germany. 

2. Participant group  

a) Persons aged 18 years or older are eligible to participate and share their own experience of using Ottobock products in text, image or video form (see section 3 a). Each participant may only participate in the draw one time. 

Employees of the Ottobock Group (within the meaning of Section 15 of the German Stock Corporation Act (AktG), with Ottobock SE & Co. KGaA affiliated companies), their relatives, and persons living in the same households of such employees, whether or not they are related, are excluded from participating.  

Residents of Quebec, Canada are not eligible. United States healthcare professionals (individuals licensed, registered, or certified under United States federal or state laws or regulations to provide health care services) are not eligible.

The Organizer may exclude participants at any time if there are legitimate reasons to do so. These may include a violation of the terms and conditions of participation, repeated participation, unlawful manipulation of the competition by manual or technical means, membership with a competition association or similar. In such cases, any winnings may also be subsequently revoked and recalled.  

3. Implementation of the giveaway/assignment of rights 

a) Participation in the competition is free of charge and does not depend on the purchase of goods or services. In order toparticipate, individuals are required to share their personal experience with Ottobock products by posting text, images or videos using the designated function on the Ottobock website [ https://www.ottobock.com/i-am-a-mountain ]. Other prerequisites include registering via the competition form, consenting to these Terms and Conditions of Participation as well as submitting the data protection statements that have been laid down there. The participant alone is responsible for ensuring that the contact details provided are correct, in particular their email and/or postal address. If any of the personal details are incorrect, they may be excluded from the giveaway. In addition, the participant confirms that they are the sole owner of all rights to the data shared by them (text, image or video) and/or are authorized to make the following assignment of rights: The participant hereby irrevocably grants Ottobock the exclusive right to use their recording, for an unlimited period of time, in printed and digital form, on TV, on the internet, on social media platforms and in any other way, globally for commercial use, in unmodified or modified form (particularly by way of publication, transmission, distribution, broadcast, etc.), as well as to permit third parties the use thereof. The recipients of the data may also include Ottobock companies or sales partners in third countries where an adequate level of data protection under the GDPR cannot be guaranteed due to the local legal situation. Furthermore, the Participant shall grant the right to add or omit the name and/or pseudonym of the participant, or to apply any other caption to the content used by Ottobock or by third parties. 

b) The giveaway shall take place in the period from June 13 – December 31, 2023 (deadline for participation). 

c) The winnings are determined according to the priority principle (receipt of information on shared experience with Ottobock is binding). Each winner will receive one of the following prizes, as determined by the Organizer, while supplies last:

  1. – Prize: "I am a Mountain" T-shirts (estimated value: 20 EUR) 

  2. – Prize: "I am a Mountain" Tote bags (estimate value: 10 EUR) 

  3. – Prize: "I am a Mountain" Sweatshirts (estimated value: 40 EUR) 

d) Winners will be notified and prizes sent by email beginning September 1st, 2023. If the winner fails to respond within 28 days, their prize will be forfeited. If a Winner is a Canadian resident, that individual must correctly answer a time-limited mathematical skill-testing question before the prize will be awarded. 

e) Cash payment, payment in tangible assets or an exchange of winnings are not possible. Prizes are non-transferable. Winners accept any changes to the prize that may be necessary as a result of factors beyond the control of the Organizer. 

f) The Organizer will notify winners via email beginning September 1, 2023. The prize notification will be sent to the email address provided by the participant when declaring their participation. If a prize notification cannot be delivered, Ottobock SE & Co. KGaA is not obliged to investigate further. 

g) Participants are not required to pay any fees to participate in the competition. The participant shall bear the line and conveyance costs incurred according to the rates of their chosen mobile phone or internet provider. 

4. Final provisions 

a) These Terms and Conditions of Participation are governed by the law of the Republic of Germany, to the exclusion of UN sales law and German international private law (CISG). 

b) Should any of these provisions be or become invalid, the validity of the remaining provisions shall hereby remain unaffected.
